In Illinois, workers' comp benefits come in four forms: medical benefits, temporary total disability (TTD) benefits, permanent disability and disfigurement benefits, and death benefits:

  • Medical benefits. Employers must pay all necessary medical expenses related to an employee injury that happened at work or an illness that can be traced to a work activity. Physician appointments, treatments, surgeries, hospitalization, rehabilitation and prescription medications may be eligible for coverage.
  • Temporary total disability (TTD) benefits. If a work-related injury or illness prevents an employee from working for three or more days, the employer is obligated to pay that employee weekly compensation equaling two-thirds of his or her gross average weekly wage for a period of one-year previous to the accident. Overtime can be included. Employers may also be obligated to pay for any vocational training needed for the employee to resume work.
  • Permanent total disability (PTD) and disfigurement benefits. When an employee's work-related injury results in deafness, amputation, blindness or another loss of function, it may permanently prevent him or her from returning to work. In such cases, the injured party may qualify for permanent partial disability (PPD) benefits or permanent total disability (PTD) benefits. When workplace injuries cause scarring or other disfigurement, the injured party may also qualify for compensation through disfigurement benefits. Many times, these PPD and PPT payments are negotiated for large lump sum payments.
  • Wage differential. An employee who is unable to return to his or her regular occupation, but who is capable of working in some capacity, may be entitled to wage differential. The injured workers is entitled to two-thirds of the difference between the new and what they would be making during their prior employment. Many times, these wage differential payments are negotiated for large lump sum payments.
  • Death benefits. Sometimes work-related injuries or illnesses result in a worker's death. When this happens, the worker's surviving spouse and children may qualify to receive weekly death-benefit payments. Such payments equal to two-thirds of the employee's average weekly wage for the year before his or her death.
